The Obligation to Rebuild
Analyzing the national mandate for the Third Temple through the lens of Rabbi Chaim ben Attar (the Ohr HaChaim) and Maimonides.
Important Halakhic & Political Context
1. The Eternal Commandment (Exodus 25:8)
"היא מצות עשה כוללת כל הזמנים, בין במדבר בין בכניסתן לארץ בכל זמן שיהיו ישראל שם לדורות."
Our translation: “It is a positive commandment encompassing all times, both in the wilderness and upon their entry into the Land, whenever Israel will be there, for generations.”
In the continuation, he notes that after the Temple was built, other locations became prohibited. The Ohr HaChaim distinguishes between the Mishkan (Tabernacle), which was a temporary structure for the wilderness, and the Mikdash (Sanctuary), which he views as a permanent national obligation that persists through generations.
2. National & Leadership Responsibility (Leviticus 25:25)
In his commentary on the laws of redeeming sold property, the Ohr HaChaim allegorically interprets the "sold heritage" as the Temple. He places the weight of redemption on a national spiritual awakening.
"והגאולה תהיה בהעיר לבות בני אדם... ועל זה עתידין ליתן את הדין כל אדוני הארץ גדולי ישראל, ומהם יבקש ה׳ עלבון הבית העלוב."
"The redemption will come through the awakening of the hearts of men... and for this, all the lords of the earth, the great ones of Israel, are destined to be held accountable, and from them G-d will seek the insult of the disgraced [abandoned] House."
In this allegorical reading, righteous leaders must awaken the people’s longing for Hashem and encourage better deeds. He places accountability on the great leaders of Israel. This supports spiritual and communal responsibility for redemption; it is not a detailed instruction to begin construction today.
3. The Rambam’s Perspective
Hilchot Beit HaBechirah 1:1
"It is a positive commandment to construct a House for G-d, prepared for sacrifices... as it is said, 'And they shall make Me a sanctuary'."
Hilchot Melakhim 11:1
"The Messianic king will arise... and build the Temple and gather the dispersed of Israel."
